The list generator is configured so as not to add, to the list, a motion vector of a same hierarchy adjacent block which is a same hierarchy block adjacent to the block to be encoded, when the block to be encoded and the same hierarchy adjacent block are integrable. The same hierarchy block is a block that has the same width and height as the block to be encoded and has existed in the same block as the block to be encoded before being finally divided.
