Abstract: A device for allocating static resources in a broadband wireless communication system and a method therefor are provided to transmit both packet and packet indicator when a static allocation mode is used in the system, thereby reducing an overhead caused by usage of an AMC(Adaptive Modulation and Coding) mode. A base station determines an MCS(Modulation and Coding Scheme) level of a terminal which receives a static allocation service(501). The base station generates a packet indicator for indicating the MCS level(503). The base station inserts the packet indicator into a statically allocated resource area(505). The base station configures a downlink frame where the packet indicator and a data packet are mapped together, and sends the frame(507).

The controller checks a quantity of data stacked in the buffer, selects and outputs a code corresponding to the data quantity to be transmitted to next frame. The packet classifier(311) classifies the packets received from a core network and delivers them to the packet scheduler(307).
