PROBLEM TO BE SOLVED: To reduce formatting time when a disk is ejected, in an optical recording medium that allows data rewriting and has several recording layers. SOLUTION: Background formatting is performed preferentially from, among a plurality of recording layers, a recording layer where user data is last recorded. For example, when compatibility with a reproduction-only device is required at the time of user data recording only on a first recording layer, in an unrecorded area closer to an inner peripheral side than the tail end position of the user data on the first recording layer, all recording layers need to be formatted (dummy data has been recorded). The background formatting is preferentially performed from the recording layer where the user data is last recorded as described above, only a part of the recording layer for last recording can be formatted during disk eject. SOLUTION: A region for recording interlayer folding back position information is set on a recording medium (e.g., End sector number in Layer 0 or a session item type 3). In response to a fact that recording on a certain recording layer reaches a maximum recording range or that data recording advances from a certain recording layer to a next recording layer, interlayer folding back position information is recorded in the recording medium. When an advancement of the data recording to another recording layer is performed at a stage prior to disk closing or sector closing, or when it is predicted that such an advancement of the data recording occurs afterwards, the interlayer folding back position information is recorded. Also where the disk is of the type for which multi-session recording is performed, the interlayer return position information is recorded with regard to a session in which folding back is performed. PROBLEM TO BE SOLVED: To shorten the recording time in a recordable multilayer disk and to improve the reliability as to a recording medium including a plurality of information recording layers and a recording device and a recording method to cope with the recording medium. SOLUTION: On the basis of the total amount of data recorded in the recording medium of a multilayer structure, an area range is set for performing data writing making each of recording layers as a target. Especially, the setting is made to minimize the recording amount of a tail end area (readout) formed for reproduction compatibility, and then a recording operation time is shortened. During reproduction, on the basis of the total amount of data to be recorded from the place of a high possibility of accurate information reproduction, an area range for performing data writing is set making each of the recording layers as the target. SOLUTION: The predetermined amount of content data is temporarily stored in a buffer means, additional information embedded in the content is detected from the content data temporarily stored in the buffer means, the content of the detected additional information is determined, and the type of the content data is discriminated. When the content data is determined to be a recordable content, the content data is recorded in a predetermined medium. When the content data is determined to inhibit recording, the recording of the content data in the medium is prevented from being carried out. In a step S14, the control computer decides whether the mean value of cycles of the binarized wobble signal satisfies the standard of DVD-RW and the dispersion of cycles of the binarized wobble signal is sufficiently small. PROBLEM TO BE SOLVED: To achieve both of the securement of interchangeability and the securement of write once ability in a recordable multi-layer disk. SOLUTION: In a write once disk recording medium having a plurality of recording layers, specified areas on inner peripheries of respective 2nd and succeeding recording layers are subjected to guard data recording by a specified timing and settled to be guard areas. To obtain reproduction compatibility, the control information (lead in data) are recorded on the inner peripheral side of at least a 1st recording layer (layer 0), but the 2nd recording layer (layer 1) and succeeding recording layers are also subjected to recording by the formation of the guard area. That is, each recording layer is subjected to recording in the specified area of the inner peripheral side of the disk wherein the disk discrimination process is carried out by a device used exclusively for reproduction, then the device used exclusively for reproduction does not erroneously identify the disk, thereby, the unrecorded area can be left in the area where user data are recordable.
